TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANNABIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL CASES, CANNABIX’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Cannabix and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms or misuse of the Site.
13. Export Control and Sanctions Compliance
You represent and warrant that you are not located in, under the control of, or a resident or national of any country or person subject to Canadian, U.S., or other applicable sanctions or export restrictions. You agree to comply with all applicable export control and sanctions laws.
14. Changes to the Site or Terms
We may modify the Site or these Terms at any time. Changes are effective when posted with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of British Columbia without regard to conflict‑of‑laws rules. You agree to the exclusive jurisdiction and venue of the provincial and federal courts located in Vancouver, British Columbia. TO THE EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO A JURY TRIAL.
16. Miscellaneous
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Failure to enforce any provision is not a waiver of the right to do so later.
Entire Agreement. These Terms constitute the entire agreement between you and Cannabix regarding the Site.
Assignment. You may not assign or transfer these Terms; Cannabix may assign these Terms without restriction.
