1. Products and Purchaser
This Limited Hardware Warranty ("Limited Warranty") is issued by Cannabix Technologies Inc. ("Cannabix") to the original purchaser (the "Purchaser") of the Breath Collection Unit (“BCU”) and the BreathLogix Alcohol Screening Device (each a "Product") purchased directly from Cannabix or an authorized reseller.
2. Warranty Coverage and Period
- Cannabix warrants that the Product will be free from defects in materials and workmanship under normal intended use (operation in accordance with Cannabix documentation, operating specifications, and published environmental conditions.) for one (1) year from the date of original retail purchase by the Purchaser (the "Warranty Period"). This Limited Warranty is valid only in the country/region of original purchase where Cannabix or its authorized service providers offer warranty service.
- If a product under warranty is returned to Cannabix or an authorized service center and is determined to be defective (see “Exclusions” in section 3), Cannabix’s obligation is limited to repair or replacement. Cannabix reserves the right to determine whether repair or replacement is the appropriate remedy. All replaced products or components become the property of Cannabix. If the Product is serviced under this Limited Warranty and the same Product is returned to the reseller or customer, the serviced Product will be covered for the remainder of the original Warranty Period and be covered under an additional warranty period of 3 months ("Repair Extension"), commencing on the date the device is shipped to the reseller or customer. The Repair Extension applies after repair shipment, regardless of remaining time. If the Product is deemed unserviceable under the Limited Warranty and a replacement Product is needed, the replacement Product will have a Warranty Period of 12 months commencing on the date the device is shipped to the reseller or customer.
- This warranty does not apply if the product has been repaired or modified by someone other than a factory authorized technician without written permission from Cannabix (see “Exclusions” in section 3); if consumables or parts other than Cannabix-approved consumables and parts are used in operation or replacement or repair; or if any Cannabix serial number has been removed or defaced.
Remedies
If a covered defect arises and a valid claim is received within the Warranty Period, Cannabix will, at its option and consistent with applicable law: (a) repair the Product with new or refurbished parts; (b) replace the Product with a new or refurbished product of equal or greater functionality; or (c) refund the original purchase price upon return of the Product.
3. Exclusions
This Limited Warranty does not cover:
- Inbound shipping to Cannabix or Authorized Service Centers
- Consumables, including all items inside Marijuana Breath Test Breath Kits, straws, printer paper, and BreathLogix cartridges (BR‑LGX‑C).
- Calibration services and preventative maintenance, which are available as paid services.
- Accuracy drift resulting from lack of required calibration or maintenance, as this is not considered a defect in materials or workmanship.
- Cosmetic damage, such as scratches or dents, that does not affect the functionality of the Product.
- Misuse, abuse, negligence, accidents, vandalism, liquid ingress, or environmental conditions outside the Product’s specifications.
- Display or touchscreen damage resulting from impact, pressure, improper cleaning, use of sharp or abrasive objects, or any other external cause. Such damage is considered physical damage and not a defect in materials or workmanship.
- Damage caused by dropping, impact, shock, tipping, improper mounting, or physical handling incidents, including damage resulting from the Product falling or being knocked over. This is considered physical damage and is not covered under defects in materials or workmanship.
- Use with improper or incompatible power sources.
- Unauthorized repairs, disassembly, or modifications.
- Use with non‑genuine or incompatible accessories or parts.
- Normal wear and tear.
- Force majeure events or other external causes beyond Cannabix’s reasonable control.
- Software, cloud services, or connectivity services, as this Limited Warranty applies only to hardware Products. These services are governed by separate terms.
4. Claim Procedure, RMA, and Shipping
Before returning a Product, please: 1. contact Cannabix to request an Incident / Return Material Authorization (“RMA Form”), complete the RMA Form with requested information and email to moc.seigolonhcetxibannac@ofni 2. After the RMA Form is reviewed and approved, an Authorization Return Number and the address of the designated service center will be provided. The product should be sent to the designated service center location with a copy of the RMA Form (postage and insurance prepaid). Cannabix or Authorized Service Centers assume no risk for damage in transit. Cannabix will pay for return postage for a Product repaired under Limited Warranty. If Cannabix determines that the failure of the Product was caused by misuse, alteration, accident or abnormal conditions of operation or handling, Cannabix will provide an estimate of repair costs before repairs are made. Following such repairs, the Product will be returned to the purchaser via ground transportation prepaid (overnight or express delivery charges are additional), and the purchaser will be billed for the repair and the shipping cost.
5. Data and Configuration
The Purchaser is solely responsible for backing up and deleting any data or removable media before returning a Product. Cannabix is not responsible for any loss of data, settings, logs, or software on serviced or replaced Products.
6. Disclaimer of Implied Warranties
To the maximum extent permitted by law, this limited warranty is exclusive and in lieu of any other warranties, conditions, or remedies, whether oral or written, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, or non‑infringement.
7. Limitation of Liability
To the maximum extent permitted by law, Cannabix will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of use, data, profits, or business). In no event will Cannabix’s aggregate liability for any claim arising out of this limited warranty exceed the amount actually paid by the purchaser for the product.
8. Statutory Rights
Nothing in this Limited Warranty excludes, restricts, or modifies rights that cannot be excluded under applicable consumer protection laws. Where such laws apply and provide greater protections, those protections prevail.
9. Export Compliance
The Product must not be used, exported, or resold in violation of applicable export control or sanctions laws.
10. Registration and Extended Warranty
Registration is recommended to expedite service communications but is not required to benefit from this Limited Warranty. An extended warranty may be available at the time of purchase or within thirty (30) days of purchase. Contact moc.seigolonhcetxibannac@ofni for more information.
11. Governing Law and Venue
This Limited Warranty is governed by the laws of British Columbia, excluding its conflict‑of‑laws rules. The parties submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia.
