1. Definitions
"MBT" means the Cannabix Marijuana Breath Test system, consisting of the Breath Collection Unit ("BCU"), Breath Cartridges ("BC"), chain-of-custody documentation, analytical workflows, and laboratory confirmation processes.
"BCU" means the Breath Collection Unit, a non-analytical device used solely to collect exhaled breath samples.
"Cannabix" means Cannabix Technologies Inc. and its affiliates.
"User" means any individual or entity that deploys, operates, or relies upon the MBT or BCU, including law-enforcement agencies, laboratories, employers, researchers, and authorized personnel.
"Confirmed Result" means an analytical result generated by an accredited forensic laboratory using liquid chromatography–tandem mass spectrometry (LC-MS/MS).
"Donor" means the individual providing a breath sample, so referred to as “Test Subject”.
2. Intended Use
Breath Collection Unit (BCU): The BCU and BC are intended solely for the collection of breath samples for drugs of abuse. The BCU does not perform analysis, does not detect, measure, or quantify drugs or alcohol, and does not display or infer results. Collected samples are shipped to, and analyzed exclusively by, a qualified forensic laboratory.
The BCU and BC are intended to support the collection and laboratory confirmation of breath samples for purposes including law-enforcement investigations, forensic and laboratory analysis, workplace safety and fitness-for-duty programs, and research, validation, and pilot programs. The BCU and BC is not intended for medical, clinical, or diagnostic use and is not approved for federal drug-testing programs, including SAMHSA, DOT, or U.S. military programs.
3. Analytical Method and Confirmation
Breath samples collected using the BCU are analyzed by an accredited forensic laboratory using LC-MS/MS, a widely accepted analytical method in toxicology and judicial contexts.
LC-MS/MS confirmation provides identification of targeted cannabinoids, subject to proper sample collection, handling, shipment, and chain-of-custody procedures.
4. What the MBT Result Demonstrates
A Confirmed Result is intended to demonstrate recent marijuana use, with an expected detection window generally corresponding to approximately 15 minutes to 4 hours prior to sample collection, based on current scientific understanding of cannabinoids in exhaled breath.
The MBT provides temporal proximity evidence of recent use, which is materially distinct from other biological matrices (e.g., blood and urine) associated with longer detection windows.
5. Limitations and Non-Impairment Determination
The MBT does not measure impairment, intoxication, or functional ability; does not establish a per-se level of intoxication; and does not determine legal guilt or innocence.
The presence of cannabinoids in breath does not, by itself, establish impairment at the time of testing.
6. Role in Law-Enforcement and Judicial Contexts
The MBT is intended to be used as part of a multi-factor assessment, and not as a standalone determinant.
Confirmed Results may be considered in conjunction with officer observations, standardized field sobriety tests (SFSTs), Drug Recognition Expert (DRE) evaluations, physical or cognitive impairment testing, and other biological matrices where permitted by law.
When used appropriately, MBT results may assist in building an evidentiary record of recent marijuana use consistent with observed behavior.
7. Evidentiary Use and Court Considerations
The MBT produces LC-MS/MS-confirmed analytical findings that may be evaluated by courts subject to applicable rules of evidence, jurisdiction-specific statutory frameworks, proper chain-of-custody and documentation, and expert testimony regarding interpretation and limitations.
Cannabix makes no representation that MBT results alone establish impairment or liability. Admissibility and evidentiary weight are determined solely by courts or adjudicative authorities.
8. User Responsibilities
Users are solely responsible for compliance with all applicable laws and regulations; obtaining required consent or legal authority for testing; operator training and competency; proper sample collection, handling, storage, shipment, and documentation; maintaining chain-of-custody; and appropriate professional interpretation of results.
Cannabix is not responsible for user procedures or third-party actions.
9. Third-Party Services
Cannabix is not responsible for the performance, accuracy, timeliness, or conclusions of collectors, forensic laboratories, courier or transport services, employers, agencies, or program administrators.
10. Data and Privacy
Cannabix does not control how Users store, process, or disclose results. Users are solely responsible for compliance with applicable privacy and data-protection laws.
11. No Warranty
Except for Cannabix’s standard 1‑year hardware warranty, all software, analytical results, and interpretations provided by the MBT and BCU are supplied ‘AS IS’ and ‘AS AVAILABLE.’ Cannabix disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and legal sufficiency.
12. Limitation of Liability
To the maximum extent permitted by law, Cannabix shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages. Cannabix’s total liability for any claim relating to the MBT or BCU shall not exceed the amount paid for the device.
13. Indemnification
Users agree to defend, indemnify, and hold harmless Cannabix, its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising out of or relating to (i) misuse or unauthorized use of the BCU and Breath Cartridges/Breath Kits (ii) improper sample handling or chain‑of‑custody failures; (iii) unlawful or non‑compliant deployment; or (iv) any representations, conclusions, or actions taken based on test results or interpretations thereof.
14. Governing Law
These Terms are governed by the laws of British Columbia, without regard to conflict-of-law principles.
15. Acceptance and Termination
Use of the MBT or BCU constitutes acceptance of these Terms. Cannabix reserves the right to terminate warranty coverage or refuse service if the Device is used outside its intended purpose.
